How Our Services Work
Painting on the Prairies is an entertainment services that provides paint parties including supplies and instruction at venues or private properties.
Painting on the Prairies provides all the materials necessary for you to complete your painting: paint, canvas, brush, easel, apron, wash cup and all other necessary supplies. Painting on the Prairies strives to maintain control over the materials we use but there are a variety of factors that can affect their quality and Painting on the Prairies cannot be held responsible for the occasional break down in materials.
You should be aware that it is impossible for your painting to turn out exactly like the one depicted for your party and Painting on the Prairies can make no guarantees on the quality of your painting or promises about your experience. Your painting will be special and unique and not like anyone else.
We will try our best to start on time for our paint parties and to complete the party in two hours, however, there are a variety of factors that can affect whether both of these things are possible. We cannot promise the exact start time or amount of time it will take to complete the party.
For public parties, the availability of tickets is based on the size of the venue. You may not be able to attend a Painting on the Prairies paint party due to the capacity limitations of the venue and so we recommend that you purchase your ticket in advance.
For private parties, the availability of paint stations is decided by the host of the party based on the number of people the host has paid for. Painting on the Prairies will only provide the correct number of paint stations as agreed upon in the paint party contract with the host.
When booking a private paint party with Painting on the Prairies it is the sole responsibility of the customer hosting and paying for the paint party to invite guests to their party and provide them with all the necessary information regarding the paint party.
It is the right of Painting on the Prairies to make changes to our services, from time to time and without notice, at our sole discretion. Painting on the Prairies is constantly making adjustments to our services to improve our offerings and therefor these terms should not be considered a full representation of how our services will always work.
Unauthorized use of Painting on the Prairies paintings are strictly prohibited. Paintings used for Painting on the Prairies paint parties are painted by and for Painting on the Prairies. Other than the painting you create at your paint party, you many not copy or reproduce any of Painting on the Prairies paintings. You may not sell or distribute any reproductions of any Painting on the Prairies painting including the one you painted at your event.
Painting on the Prairies will communicate with you about your purchase, including notices and information about your paint party. Painting on the Prairies also may send you promotions, special offers, announcements, surveys or newsletters by email or other methods.
If you no longer with to receive promotional communication from Painting on the Prairies you must inform us by emailing firstname.lastname@example.org. You may also send us regular mail at 614 St. Anne’s Road, Winnipeg, MB, R2M 3G9.
When you purchase a ticket to one of Painting on the Prairies paint parties you are expressly giving permission to Painting on the Prairies to charge you the ticket fee at the current price and any other charges associated with your paint party ticket to the payment method that you provided upon check out. You will be charged the fee for the ticket on the day you purchase the ticket and not on the day of the paint party. Please note that our prices are subject to change without notice.
When you book a private party with Painting on the Prairies you will be expressly agreeing to pay the invoice amount for your party by the date specified in your contract and on your invoice and not on the date of the party. You will be charged for the full amount of party booked, based on the number of painters, and the date of your party will not be guaranteed until you have paid your invoice. Should you add more painters to your party after the invoice is paid, you agree to inform Painting on the Prairies of the additional painters as soon as you know about them and to pay for their attendance on the day of the party. If you do not pay the outstanding balance for added painters, Painting on the Prairies will not provide a paint station for them.
Your Painting on the Prairies ticket for public venue events is non-refundable.
You may request a date transfer to another scheduled party date with 72 hours’ notice of your original paint party date purchased. After 72 hours, no transfer of date will be granted but you can send someone else in your place to your scheduled paint party date purchased.
For private paint parties there is a non-refundable deposit of half the invoiced cost of your booked and paid for paint party. You may cancel your party and receive a refund for the other half of the invoiced cost of your booked and paid for paint party with 14 days’ notice of the paint party date or transfer your paint party date to another date without losing your deposit within the same 14 day notice period. You may contact Painting on the Prairies for individual consideration on a case-by-case basis.
If you cancel your Painting on the Prairies paint party and used a promotion, there is not refund or credits for the unused promotion.
Painting on the Prairies promotions cannot be combined with any other offer.
By connecting to Painting on the Prairies through social media accounts, such as Facebook, certain information will be shared about you to those who have access to view information about you on the specified social media platform. By connecting to us on Facebook you will also be able to take advantage of features and information that we make available through the social media network. Please view and use your account settings and privacy settings to see what type of control you have over the information that is shared and whom it is shared with.
You are consenting to the release and use of information about you to others, in relation to any social media account that you connect to Painting on the Prairies with. If you do not want your activity with Painting on the Prairies to be shared on the social media account you are connected to us with, you must contact Painting on the Prairies at email@example.com to have your information removed.
Some Painting on the Prairies paint parties may have an age restriction due to the venue they are being held at. If the venue hosting the paint party is a licensed venue that prohibits minors to be on their premise, then Painting on the Prairies will also restrict the attendance of minors to its paint party. For these parties, customers will be asked to provide their age upon purchase of their ticket and may be asked to provide identification on the date of the party. Painting on the Prairies cannot be held responsible for selling a ticket to a minor for an age restricted party if the minor has lied about their age upon purchasing the ticket. Painting on the Prairies will refuse to provide access to the party should a minor attend with a purchased ticket.
When you attend a public party at a venue that is hosting a Painting on the Prairies paint party you will encounter services provided by them. This may include but is not limited to food and beverage services at the party venue. Painting on the Prairies does not endorse the services provided by the venue and cannot be held responsible for their services to you. You agree that you are responsible for all additional charges that you incur at your paint party, including but not limited to food and beverage charges.
In some situations your ticket may include a specified service from the party venue. In these cases the party venue will provide you with the specified service, such as a beverage, only on the night of the party. Your included services is not transferable to any other party date and cannot be used at the venue at any other time except the specified party date. If you choose not to take advantage of the included service you forfeit your claim to it.
Your use of any party venue is at your own option and risk. You agree to indemnify and hold harmless Painting on the Prairies for all claims involving or related to the services provided by the party venue as well as all information that maybe transmitted as a result of your use of their services or attendance at their venue.
Painting on the Prairies welcomes customer reviews to be posted through our website and Facebook account but reserves the right to reject, remove or edit content of these reviews at any time without notice. You may not post reviews that contain language considered profane, discriminatory, harsh, obscene, threatening or objectionable. You may not post phone numbers, mail or email addresses, misleading information or defamatory remarks in regards to Painting on the Prairies, or personal attacks on Painting on the Prairies and its employees. It is the sole discretion of Painting on the Prairies to review and remove content for any reason and no reason.
Right to Terminate
Painting on the Prairies reserves the right to restrict or terminate your use of www.ontheprairies.ca or our paint parties, for any or no reason and without notice.
Limitations of Liability
All services provided by Painting on the Prairies is provided to you without any warranty of any kind. Painting on the Prairies cannot guarantee that your interaction with its services will be uninterrupted or error-free and reserves the right to modify any and all aspects of the services of your paint party without notice or compensation to you. Painting on the Prairies cannot be held liable for any of the following: a) errors or omissions in the information provided by Painting on the Prairies services or website b) any interruption of failure in the availability of a paint party c) content displayed or delivered by its website or services d) any damages or losses as a result of or related to your paint party or party venue. Painting on the Prairies makes no guarantees of satisfaction or quality of your painting or paint party.
Neither Painting on the Prairies nor any of its employees or representatives can be held liable to you for any personal injury or damages resulting from participation in a paint party whether private or public.
In the event that any paint party should be delayed or canceled due to a flood, fire, tornado, natural disaster, power outage, war, riot or other situation outside of Painting on the Prairies control, neither Painting on the Prairies, its party venues or you shall be held liable for the failure to perform the services.
Any and all photos or video taken at a Painting on the Prairies paint party become the property of Painting on the Prairies and it is at our sole discretion to use and reproduce such media. You acknowledge that Painting on the Prairies may use and distribute any photos or video taken at a paint party for marketing purposes. You also acknowledge and allow Painting on the Prairies to use any photographs and video taken at a paint party on social media. Should you disagree with the use of such photographs or video you should not use or otherwise attend a Painting on the Prairies paint party.
Use of Submitted Information
Should you submit any comments, ideas, review, information, concepts, techniques or other material to Painting on the Prairies through any communication you are allowing Painting on the Prairies to use such submissions waive all rights to such submission.
By using Painting on the Prairies services, website and paint parties you acknowledge that you have the full right and authority to enter into the Terms on your own behalf.
